1. GENERAL

1.1 By Pakke.dk is understood:

1.2 By customer is understood: The person who either acts for himself, another person or on behalf of a company as a proxy holder makes an order at Pakke.dk.

1.3 By sender is understood: The party who had the last contact with the shipment, before handing over to the freight company that is responsible for the shipment.

1.4 By recipient is understood: The party to whom the shipment is sent.

1.5 Be aware that the customer, payer, owner, sender and recipient are five legally responsible parties with different responsibilities, whether they are one and the same or different physical and/or legal persons. General law and practice apply unless otherwise specified in these terms or subcontractors’ terms.

1.6 These business terms constitute the contractual basis on which Pakke.dk will transport parcels, pallets, containers, goods and documents.

1.7 Unless special services have been agreed upon, the transport services that Pakke.dk’s customer service must secure, are limited to the shipment of the ordered and, where appropriate, pickup and shipment delivery.

1.8 Rejection of shipment. Pakke.dk offers shipment on behalf of recognized freight companies, but does not ship themselves, and is not a universal freight company under the Postal Act. Pakke.dk therefore reserves the right, at its discretion, to refuse transportation of any package up to and including the time when the package is submitted to Pakke.dk or subcontractors for the purpose of transportation. For example, this also applies to parcels which may meet the suppliers' conditions, but are considered unsuitable for transport by the driver, due to the nature of the contents, inadequate packaging in relation to the particular nature of the content or the like.

1.9 These business terms apply to all Pakke.dk's activities and services performed on behalf of the customer, whether these are performed by Pakke.dk or by Pakke.dk's subcontractors.

1.10 IMPORTANT NOTE: The present conditions thus constitute the primary contractual basis that is ONLY deviated from, to the extent it is stated in these terms and conditions. Deviations are made to secure the goods and restrictions that are peculiar to the individual subcontractors, which is why in these situations reference is made to the suppliers' own terms and conditions, which are also attached to the customer's order.

1.11 Pakke.dk uses subcontractors such as: UPS, GLS, DAO, Postnord, DHL and FEDEX to manage Pakke.dk's services. Pakke.dk contacts these on behalf of the customer, in case of any customer service issues. However, depending on the situation, there may be cases where it will be necessary for the customer to communicate directly with the subcontractor.

1.12 Terms that do not appear in the present terms and conditions or the referenced subcontractors' terms of business, or otherwise not agreed on by Pakke.dk and the customer, cannot be invoked.

2. PRICE

2.1 WHAT IS INCLUDED IN THE PRICE?

2.1.1 The stated prices include fuel surcharges and are shown both inclusive and exclusive VAT.

2.1.2 Prices for shipments outside the EU are VAT-free.

2.1.3 The price is free of duties and taxes, cf. the section on Customs and Taxes. The price is calculated based on the weight or size of the shipment, the so-called volume weight.

2.1.4 Volume calculation is the transport industry's way of converting the volume into a figure comparable to the weight of the shipment. To find the volume weight, you first multiply the length, width and height in cm. Then divide by 5000. Ex. (LxWxH)/5000. Some subcontractors may use other volume calculation factors.

2.1.5 The volume weight is compared with the actual weight. The highest weight of the two is the basis of calculation for the price.

2.1.6 All shipments are measured and weighed electronically on route to the recipient, and if there is a deviation from the information provided by the customer, which makes the shipment more expensive than calculated, Pakke.dk reserves the right to post-charge the customer for the deviation, and to impose a post-invoicing fee of DKK 95,- and, if necessary, reject the shipment. If the customer orders and pays for larger or heavier shipments than the customer receives, this does not allow for compensation or refund of the difference between ordered and factually measured and weighted shipping.

2.1.7 The price is continually adjusted, and the price calculation may therefore vary.

2.1.8 The price includes coverage for losses, through the chosen supplier's insurance. In case the selected supplier does not offer coverage, Pakke.dk's standard insurance will come into effect and ensure the customer a coverage of up to DKK 500,- including VAT. If the individual subcontractor offers a standard insurance, this insurance covers the entire customer's expense. If additional coverage is required, the customer can buy additional insurance through pakke.dk. Further information can be found in chapter 15 "Insurance".

2.1.9 The price of shipments is calculated on the basis of the customer's entered information (dimensions, weight, amount, collection point, destination and desired service level) in the price calculator, which can be found on www.pakke.dk

2.1.10 NB: It is the customer's own responsibility to ensure that the information entered is correct. If the information does not hold true, it is the customer alone who is responsible for any expenses that THIS MAY CAUSE.

2.1.11 The price calculator on www.pakke.dk always forms the basis for the customer's price, unless another written offer has been received from Pakke.dk, and the price stated and confirmed during the order is valid and is considered accepted when the order is completed at www.pakke.dk.

2.2 COSTS NOT INCLUDED IN THE PRICE

2.2.1 Fees for errors, changes or defects on the part of the customer.
In case of faults or omissions on the part of the customer, the customer will be charged for any expenses that this may cause, cf. pakke.dk’s and relevant subcontractors' terms and conditions.
It is not limited to, but is primarily calculated following these standard rates:

2.2.1.1 Change of recipient address in case of error or redirection to new address within the same postal code DKK 49,-

2.2.1.2 Incomplete or lacking address DKK 49,-

2.2.1.3 Label not printed and attached DKK 25,-

2.2.1.4 Incomplete or lacking packaging DKK 49,-

2.2.1.5 Incorrect information regarding weight or size DKK 95,-

2.2.2 Recipient dependent expenses

2.2.2.1 When the recipient refuses reception, freight providers and authorities are assigned tasks and responsibilities that are beyond what is expected, and this usually entail expenses. Therefore, both subcontractors and customs authorities, etc., may charge for miscellaneous expenses, as well as any expenses incurred in destruction or return of shipment. Any expense in this regard is the sole responsibility of the customer, who will be billed accordingly.

2.2.2.2 In general, all expenses related to return shipping are paid by the sender/customer and not Pakke.dk.

3. ORDER CONFIRMATION/INVOICE

3.1 When ordered and paid, the invoice and address label are sent to the customer via e-mail. In addition, the present terms and conditions, as well as those of the subcontractor, are sent, cf. the Consumer Contracts Act.

3.2 NB: PLEASE NOTE THAT THESE TERMS ARE FOR CUSTOMER PACKAGING REQUIREMENTS AND THE PREPARATION OF THE DELIVERY, THE SUBCONTRACTORS HANDLING, DELIVERY, INSURANCES AND THE LIKE.

3.3 If the customer has an invoice system and pays via invoice, the address label is sent by e-mail and the invoice is sent at a later date.

3.4 When the payment is made by the customer, the amount is reserved on the payment card used. When the address label is delivered, the payment deducted on the payment card, the address label acting as a payment note on the shipping. In the case of pallet transport, the money is deducted on the card upon conclusion of the agreement, as inclusion of a carrier is a part of the ordered service. NB: Please note that use of the right of withdrawal prior to collection will result in a fee for unsuccessful haulage.

4. CANCELLATION/RIGHT OF WITHDRAWAL

4.1 As a point of departure, Pakke.dk's services are exempt from the right of withdrawal. If you regret a purchase/order, it can be canceled by contacting Pakke.dk either in writing via e-mail or by telephone. If inquiries are made via e-mail, this must be marked with the heading "Cancellation” and sent to support@pakke.dk, with associated order number, order date, name and telephone number.

4.2 Cancellations can usually be submitted up to 2 hours before the agreed pick-up time.

4.3 The money is returned to a bank account within 1-3 banking days for private customers and companies that do not have an invoice system. However, this may vary depending on the credit card used for the purchase.

4.4 Once the shipment has been picked up or delivered, the right of withdrawal is void.

5. COLLECTION OF PACKAGES

5.1 When a service with pickup is selected, it is the customer's responsibility to ensure that the shipment is properly packaged and ready for collection. For additional terms and conditions regarding collection, please refer to the selected supplier’s terms and conditions for the selected service, which is attached to the order confirmation.

5.2 NB: FAILURE TO COMPLY WITH THE REQUIREMENTS OF THE SELECTED SUPPLIER’S CONDITIONS MAY INCLUDE SIGNIFICANT EXPENDITURE AND/OR LOSS OF THE DELIVERY AND VOID OF INSURANCE FOR PAKKE.DK AND THEIR SUBCONTRACTORS.

6. SUBMISSION OF PACKAGE

6.1 When a service with pickup is selected, it is the customer's responsibility to ensure that the shipment is properly packaged and ready for collection. For additional terms and conditions regarding the collection point, please refer to the selected supplier’s terms and conditions for the selected service, which is attached to the order confirmation.

6.2 NB: FAILURE TO COMPLY WITH THE REQUIREMENTS OF THE SELECTED SUPPLIER’S CONDITIONS MAY INCLUDE SIGNIFICANT EXPENDITURE AND/OR LOSS OF THE DELIVERY AND VOID OF INSURANCE FOR PAKKE.DK AND THEIR SUBCONTRACTORS.

7. DELIVERY

7.1 NB: Please note that the shipping time specified in the price calculator is only indicative, and any warranties or compensation for late delivery depend on the subcontractor's terms and conditions.

7.2 For additional terms and conditions regarding delivery, please refer to the selected supplier’s terms and conditions for the selected service, which is attached to the order confirmation.

7.3 NB: FAILURE TO COMPLY WITH THE REQUIREMENTS OF THE SELECTED SUPPLIER’S CONDITIONS MAY INCLUDE SIGNIFICANT EXPENDITURE AND/OR LOSS OF THE DELIVERY AND VOID OF INSURANCE FOR PAKKE.DK AND THEIR SUBCONTRACTORS.

8. DELAY

8.1 In some cases, longer delivery times may occur due to the packages being processed in customs. Customs can always choose to check a package or “pause” the shipment until the information they need is available. Unfortunately, this will sometimes increase delivery times beyond what was stated. In the event of any interference by public authorities which is not due to actions of Pakke.dk or subcontractors, all delivery deadlines and any associated guarantees and their respective options for compensation are void.

9. PACKAGE SIZE AND WEIGHT

9.1 When ordering the shipment, the customer will only be offered services from suppliers who are able to handle a shipment with the stated measurements and weight data. If the physical shipment deviates from the stated measurements, it may result in rejection of shipment or post-invoicing, cf. the Price section. The sizes offered are not only dependent on the subcontractor's general services and options, but also on the specific agreement between Pakke.dk and the specific subcontractor, which is why there may be suppliers who will not be offered in the price calculator, despite their capacity by direct trade.

10.THE CONTENT OF THE PACKAGE

10.1 NB: ONLY CONTENT WITH CORRECT VALUE DECLARATION IS TO BE CONSIDERED AS LEGAL DELIVERIES. IN CASE OF DOUBT IN ANY ISSUE OF COMPENSATION ANY VALUE OF ITEMS IS SET TO THE DOCUMENTED COST PRICE. USED ITEMS ARE VALUED AT THE LOWEST OF THE TWO FOLLOWING AMOUNTS:

- THE DOCUMENTED COST PRICE
- THE CURRENT SALES VALUE

CONTENTS WITH PROVABLE FALSE VALUATION DECLARATION ARE CATEGORIZED AS ILLEGAL PRODUCTS, WHICH VOIDS PACKAGE.DK’S RESPONSIBILITIES.

10.2 VALUE SHIPMENT

10.1.1 Shipments with jewelry, watches, works of art, antiques, precious stones, stamps, unique items, gold or silver, must not exceed a value or declared value per shipment of more than DKK 5000,- or equivalent in local currency, unless a special agreement has been made with Pakke.dk.

10.1.2 NB: PLEASE NOTE THAT SHIPMENTS OF A VALUE ABOVE 5000,- IN NO CIRCUMSTANCES WILL INCLUDE COMPENSATION NEITHER FROM PAKKE.DK OR SUBCONTRACTIORS, UNLESS A SPECIFIC ADDITIONAL INSURANCE IS SIGNED FOR THE PACKAGE VALUE. NOR CAN ANY CLAIMS BE MADE ON AMOUNTS THAT EXCEED THE INSURED AMOUNT, AND/OR IS MENTIONED IN ANY CUSTOMS DOCUMENTS CF. 10.1.3, UNLESS OTHERWISE STATED BY DANISH LAW.

10.1.3 IN THE EVENT OF A CONFLICT BETWEEN ANY ADVISED CUSTOMS VALUE AND VALUE SET FORTH IN THE SUPPLEMENTARY INSURANCE, THE LOWEST AMOUNT OF THE TWO IS TO BE USED FOR DETERMINING INSURANCE OF DAMAGES, AND ALSO BY APPLICABLE RULES FOR WHAT IS INSURABLE.

10.3 PROHIBITED ITEMS AND DANGEROUS GOODS

NB: PLEASE NOTE THAT IT IS CUSTOMER'S RESPONSIBILITY TO ENSURE THAT PROHIBITED ITEMS ARE NOT SENT. PAKKE.DK DOES NOT ASSUME ANY RESPONSIBILITY FOR CHECKING BEFORE SHIPPING. SHIPPED PROHIBITED ITEMS, EXCLUDING PAKKE.DK’S RESPONSIBILITY AND ANY EXPENDITURE FOLLOWED BY SHIPPING OF PROHIBITED PRODUCTS, INCLUDING CONSEQUENTIAL DAMAGES AND THIRD-PARTY INSURANCES, IS ASSUMED ONLY BY THE CUSTOMER. IN WORST CASE, DISPATCH OF PROHIBITED ITEMS MAY RESULT IN CRIMINAL LIABILITY.

10.4 Prohibited goods that are NOT allowed with Pakke.dk:

10.3.1 Alcoholic beverages

10.3.2 Animal skin (from wild animals)

10.3.3 Paint

10.3.4 Easy-to-sell goods with value exceeding DKK 5000.- are prohibited, unless a separate agreement has been made with Pakke.dk. Easy-to-sell goods can be artworks, antiques, precious stones, currency, gold, silver, jewelry, watches and the like.

10.3.5 Goods that are irreplaceable, including rare goods, goods that are no longer produced, collectors' items and the like. 

10.3.6 Dangerous goods according to the ADR Convention. These are generally objects that can be dangerous if they are not handled and transported according to specific regulations. Examples may be containers under pressure, including deodorants, explosives, toxins and the like. Full list is available on the police website.

10.3.7 Firearms

10.3.8 Furs

10.3.9 Ivory and ivory products

10.3.10 Living animals

10.3.11 Money and transferable securities (checks, bills, bonds, bank books, prepaid credit cards, stock letters or other marketable securities)

10.3.12 Perishable goods

10.3.13 Personal items (except for shipments to USA)

10.3.14 Plants

10.3.15 Pornographic material

10.3.16 Seeds

10.3.17 Tobacco and tobacco products

10.3.18 Goods that in their design look like or can be confused with dangerous goods or illegal goods. Examples may be a practical joke products, pranks and the like, which in their design can be perceived as dangerous. In case of need for this type of shipment, it is the customer's responsibility to make a separate written agreement with Pakke.dk before the order for shipment is considered legal.

11. PACKAGING

11.1 The customer is responsible for adequate and proper packaging and labeling with a filled address label per. package (see the Address Label section).

11.2 Pakke.dk does not check packaging and does not replace transport damages if it is assessed that packaging was not adequate.

11.3 Shipments must be packaged, with both internal and external packaging, so that they can be handled in up to several packing facilities without suffering damage.

11.4 The outer packaging must be strong and intended for, or at least quality-appropriate for, global package transport. The material on the outer layer must be CARDBOARD, unless otherwise agreed in writing with Pakke.dk, prior to dispatch.

11.5 The inner packaging must be tight-fitting, shock-absorbing material and must be adapted to the contents.

11.6 All cavities in all directions must be filled with a suitable material to protect the contents, even in the case of the shipment is turned upside down or sideways during transport.

11.7 The sender must ensure that there is no room for displacement, pressure or shock, either between the objects or between the contents and the sides of the packaging.

11.8 For further description of the supplier's requirements for packaging, please refer to the chosen supplier's terms and conditions attached to the order confirmation.

11.9 NB: PLEASE NOTE THAT NON-COMPLIANCE WITH PACKAGING REQUIREMENTS MAY LEAD TO EXPENDITURES AND VOID OF INSURANCE CLAIMS.

11.10 In the case of transport damages, the following are not covered by basic insurance or supplementary insurance, but are still covered in case of lost packages:

11.10.1 Porcelain and glass and ceramics.

11.10.2 Electronics (applies to all electrical goods)

11.10.3 Technical equipment, including flat TV screens, computers, IT, laser equipment

11.10.4 Further information about compensation and insurance for transport damages and loss is explained in the section Insurance/Limitation of Liability.

12. ADDRESS LABEL

12.1 It is the customer's duty to ensure that there is an address label on each package or pallet in the shipment.

12.2 The address label to be used is sent from Pakke.dk to the e-mail address the customer has provided.

12.3 It is the customer's responsibility to forward the address label to the sender if the sender and customer are not the same.

12.4 NB: It is not allowed to change the transmitted address label, as information is read on the bar code. If the address label is changed or damaged/incomplete upon collection, Pakke.dk and the subcontractor's liability for the security of the shipment is void, without the possibility of claims by the customer, if the package is damaged or lost. Any additional costs in relation to the package's handling are the sole responsibility of the customer.

13.Customs

13.1 Our subcontractors or a local Broker make the administrative clearance, up to 6 customs tariff lines, free of charge.

13.2 Pakke.dk is not responsible for any other expense or administrative work related to import/export clearance than the above mentioned 6 tariff lines.

13.3 If there are goods in the shipment for which the customs authorities of the respective sender and recipient countries collect customs duties, those expenses rely on dealings between those customs authorities, sender and recipient. In such cases, Pakke.dk can assist with customer service and communication with the respective parties to the extent possible, but is not financially responsible, and these expenses are not included, either wholly or partly in the shipping price.

13.4 If the recipient country imposes import duties on the shipment, the customs charge is sent to the recipient. If the consignee refuses to pay the customs duty or to receive the shipment, it is the responsibility of the consignor to cover any duty owed, as well as any other costs relating to the customs handling, including but not limited to, handling, storage and possible destruction charges.

13.5 If the exporting country imposes export duties, customs collection will be sent to the customer. Similarly, it is the customer's full responsibility to ensure that any other requirements, such as, for example, permits, registrations and the like, are timely and correctly prepared.

13.6 For calculation/specification of duties and other possible administrative requirements, Pakke.dk refers to the customs authorities of the sending and receiving country. 

14. CUSTOMS DOCUMENT

14.1 For shipments outside the EU, a customs document (which is also often referred to as a pro forma invoice/commercial invoice or the like) must be filled in, which must be printed and attached to one of the packages in the shipment. Another 2 copies must be printed and given to the driver.

14.2 In the event of errors or omissions in the completion, printing, affixing and delivery of the customs document by the customer, Pakke.dk's obligations lapse and any expenses are solely the responsibility of the customer.

14.3 NB: PLEASE NOTE THAT SHIPMENTS OF A VALUE ABOVE 5000,- IN NO CIRCUMSTANCES WILL INCLUDE COMPENSATION NEITHER FROM PAKKE.DK OR SUBCONTRACTIORS, UNLESS A SPECIFIC ADDITIONAL INSURANCE IS SIGNED FOR THE PACKAGE VALUE. NOR CAN ANY CLAIMS BE MADE ON AMOUNTS THAT EXCEED THE INSURED AMOUNT, AND/OR IS MENTIONED IN ANY CUSTOMS DOCUMENTS CF. 10.1.3, UNLESS OTHERWISE STATED BY DANISH LAW.

14.4 IN THE EVENT OF A CONFLICT BETWEEN ANY ADVISED CUSTOMS VALUE AND VALUE SET FORTH IN THE SUPPLEMENTARY INSURANCE, THE LOWEST AMOUNT OF THE TWO IS TO BE USED FOR DETERMINING INSURANCE OF DAMAGES, AND ALSO BY APPLICABLE RULES FOR WHAT IS INSURABLE.

14.5 NB: ONLY CONTENT WITH CORRECT VALUE DECLARATION IS TO BE CONSIDERED AS LEGAL DELIVERIES. IN CASE OF DOUBT IN ANY ISSUE OF COMPENSATION ANY VALUE OF ITEMS IS SET TO THE DOCUMENTED COST PRICE. USED ITEMS ARE VALUED AT THE LOWEST OF THE TWO FOLLOWING AMOUNTS:

- THE DOCUMENTED COST PRICE
- THE CURRENT SALES VALUE
CONTENTS WITH PROVABLE FALSE VALUATION DECLARATION ARE CATEGORIZED AS ILLEGAL PRODUCTS, WHICH VOIDS PACKAGE.DK’S RESPONSIBILITIES. See CHAPTER 10.

15. INSURANCE

15.1 The shipment is, as a rule, covered for losses through the chosen supplier's insurance, cf. the subcontractor's trading conditions. In case the selected supplier does not offer coverage, Pakke.dk's standard insurance will come into effect and ensure the customer a coverage of up to DKK 500,- including VAT. If the individual subcontractor offers a standard insurance, this insurance covers the entire customer's expense.

15.2 NB: PLEASE NOTE THAT SHIPMENTS OF A VALUE ABOVE 5000,- IN NO CIRCUMSTANCES WILL INCLUDE COMPENSATION NEITHER FROM PAKKE.DK OR SUBCONTRACTIORS, UNLESS A SPECIFIC ADDITIONAL INSURANCE IS SIGNED FOR THE PACKAGE VALUE. NOR CAN ANY CLAIMS BE MADE ON AMOUNTS THAT EXCEED THE INSURED AMOUNT, AND/OR IS MENTIONED IN ANY CUSTOMS DOCUMENTS CF. 10.1.3, UNLESS OTHERWISE STATED BY DANISH LAW.

15.3 IN THE EVENT OF A CONFLICT BETWEEN ANY ADVISED CUSTOMS VALUE AND VALUE SET FORTH IN THE SUPPLEMENTARY INSURANCE, THE LOWEST AMOUNT OF THE TWO IS TO BE USED FOR DETERMINING INSURANCE OF DAMAGES, AND ALSO BY APPLICABLE RULES FOR WHAT IS INSURABLE.

15.4 NB: ONLY CONTENT WITH CORRECT VALUE DECLARATION IS TO BE CONSIDERED AS LEGAL DELIVERIES. IN CASE OF DOUBT IN ANY ISSUE OF COMPENSATION ANY VALUE OF ITEMS IS SET TO THE DOCUMENTED COST PRICE. USED ITEMS ARE VALUED AT THE LOWEST OF THE TWO FOLLOWING AMOUNTS:
- THE DOCUMENTED COST PRICE
- THE CURRENT SALES VALUE
CONTENTS WITH PROVABLE FALSE VALUATION DECLARATION ARE CATEGORIZED AS ILLEGAL PRODUCTS, WHICH VOIDS PACKAGE.DK’S RESPONSIBILITIES. See CHAPTER 10.

15.5 If there is no supplementary insurance, there will be no claim for compensation against Pakke.dk for amounts that exceed the basic coverage of the 500,-

15.6 Any coverage that the customer desires that exceeds Pakke.dks basic insurance or the chosen subcontractor's insurance will only be possible if an additional insurance is agreed upon.

15.7 Supplementary insurance will cover loss or damage to goods that cannot be categorized as prohibited or dangerous goods. However, not for transport damage to objects covered by the section “Packaging".

15.8 NB: If the customer sends prohibited or dangerous goods, this may lead to claims for damages and the customer will be liable to criminal liability if it causes material or personal injury cf. chapter 10.

15.9 The size of the insurance is stated under the following section on Limitation of Liability.

16. LIMITATION OF LIABILITY

16.1 If the customer does not comply with the present terms and conditions, Pakke.dk's liability for damages will lapse in the event of the following damage or loss.

16.2 Without supplementary insurance, in no event can compensation claims be directed against Pakke.dk, for amounts exceeding the basic insurance coverage of DKK 500.00.

16.3 NB: PLEASE NOTE THAT SHIPMENTS OF A VALUE ABOVE 5000,- IN NO CIRCUMSTANCES WILL INCLUDE COMPENSATION NEITHER FROM PAKKE.DK OR SUBCONTRACTIORS, UNLESS A SPECIFIC ADDITIONAL INSURANCE IS SIGNED FOR THE PACKAGE VALUE. NOR CAN ANY CLAIMS BE MADE ON AMOUNTS THAT EXCEED THE INSURED AMOUNT, AND/OR IS MENTIONED IN ANY CUSTOMS DOCUMENTS CF. 10.1.3, UNLESS OTHERWISE STATED BY DANISH LAW.

16.4 IN THE EVENT OF A CONFLICT BETWEEN ANY ADVISED CUSTOMS VALUE AND VALUE SET FORTH IN THE SUPPLEMENTARY INSURANCE, THE LOWEST AMOUNT OF THE TWO IS TO BE USED FOR DETERMINING INSURANCE OF DAMAGES, AND ALSO BY APPLICABLE RULES FOR WHAT IS INSURABLE

16.5 NB: ONLY CONTENT WITH CORRECT VALUE DECLARATION IS TO BE CONSIDERED AS LEGAL DELIVERIES. IN CASE OF DOUBT IN ANY ISSUE OF COMPENSATION ANY VALUE OF ITEMS IS SET TO THE DOCUMENTED COST PRICE. USED ITEMS ARE VALUED AT THE LOWEST OF THE TWO FOLLOWING AMOUNTS:

- THE DOCUMENTED COST PRICE
- THE CURRENT SALES VALUE
CONTENTS WITH PROVABLE FALSE VALUATION DECLARATION ARE CATEGORIZED AS ILLEGAL PRODUCTS, WHICH VOIDS PACKAGE.DK’S RESPONSIBILITIES. See CHAPTER 10

16.6 Delays of deliveries only entail the possibility of compensation if this is agreed upon in writing with Pakke.dk. The written agreement constitutes the basis for the terms that result in compensation. Subcontractor's terms for compensation for delays are not valid without this agreement between customer and Pakke.dk.

16.7 Under no circumstances can Pakke.dk be held liable for indirect losses, operational losses, lost profits or other losses than the liability mentioned in these conditions. Pakke.dk is likewise not responsible for any losses resulting from circumstances that can be characterized as work stoppage, force majeure, terrorist acts, strike, war, natural disasters, cyber-attacks, etc.

16.8 Delays caused by customs authorities

16.8.1 Pakke.dk is not responsible for shipments that are shipped to local customs authorities. Release from local customs is solely the responsibility of the customer, the sender and the recipient.

16.8.2 No claim can be made for the payment of insurance in relation to shipments which are in the custody of the customs authorities.

16.8.3 Any expenses relating to the return of shipments from customs shall be incurred solely by the customer. Including return costs, customs tax, cost of destruction, storage, or similar local handling costs.

17. JURISDICTION

17.1 All disputes concerning the agreement and these general business conditions must be settled in accordance with Danish law. The court in Hjørring, DK must be the first instance for jurisdiction.

18. COMPLAINT

18.1 If you are not satisfied with the service provided, you can contact customer service via the contact page at www.pakke.dk

18.2 As a point of departure, you do not have a 2-year warranty, as this is a service. Therefore, please contact us immediately if you experience any problems.

18.3 COMPLAINTS OVER LOSS

18.3.1 If one or more packages are missing in your shipment upon receipt, the receiver should immediately inform the driver if possible. The customer should also contact Pakke.dk within 3 working days after receipt, as an investigation requires urgent action and is naturally made more difficult with each passing day.

18.3.2 If Pakke.dk is not contacted within 3 working days after actual or expected receipt, Pakke.dk's liability for damages can be waived.

18.3.3 If a complete shipment has been lost, the customer must contact Pakke.dk in writing via the contact form at https://www.pakke.dk/Kontakt_os#/ within 90 days of the expected receipt of the goods. If this deadline is not complied with, Pakke.dk's liability will lapse.

18.4 Complaints over damages

18.4.1 If your parcel is damaged, you must do the following within 3 working days, in order to claim any compensation:

18.4.1.1 Always check the external condition of the goods at reception.

18.4.1.2 Document the damage by taking photos.

18.4.1.3 Contact Pakke.dk at the contact page at www.pakke.dk

18.4.1.4 Provide order number and attach picture documentation.

18.4.2 The shipment including packaging must be stored so that it is possible for Pakke.dk to inspect the damages personally for up to 4 weeks after the complaint has been submitted, otherwise the liability for damages will be waived.

18.4.3 Recipient must make damaged packages ready to be picked up at the delivery address in original packaging for up to 4 weeks after receipt, if requested by Pakke.dk. If this is not possible, the customer and/or recipient loses the right to compensation.

19. THE LIMITATION PERIOD

19.1 All claims against Pakke.dk must be made in writing as soon as reasonably possible. In case of damage or shortage/missing packages in a shipment, the customer or recipient must complain to Pakke.dk within 3 working days after delivery, as all requirements may otherwise lapse.

20. APPEALS

20.1 If you as a consumer want to complain about your purchase, you must contact Pakke.dk via https://www.pakke.dk/Kontakt_os#/.

What we do with your personal information.

21.1 For you to deal with us, we need the following information:

21.2 We make the registration of your personal information for the purpose of providing the service to you.

21.3 The personal information is registered with Pakke.dk ApS and stored for five years, with a view to compliance with the Accounting Act, after which the information is deleted.

21.4 When collecting personal data via our website, we ensure that it always happens by submitting your explicit consent so that you are informed exactly what information is being collected and why.

21.5 We do not encrypt stored customer information.

21.6 We do not transmit customer information encrypted. However, all payments are made via encrypted and secure connections that are managed by NETS in collaboration with ePay.

21.7 Information submitted to Pakke.dk is not disclosed or sold, in any way, to third parties, and we do not record any personal information.

21.8 We also collaborate with a number of other companies, including freight suppliers, who store and process data. The companies treat information solely on our behalf and may not use it for their own purposes.

21.9 We only work with data processors in the EU or in countries that can provide your information with sufficient protection.

21.10 The review page Trustpilot is given access to personal data solely for the purpose of confirming the customer relationship with Pakke.dk. The information given to Trustpilot, is not disclosed or sold in any way to a third party on Trustpilot.

21.11 As registered with Pakke.dk, you always have the right to object to the registration. You also have the right to know what information is registered about you. 22. NOTES

Prohibited Goods: Alcoholic beverages, Articles of particular value (e.g. works of art, antiques, precious stones, gold and silver), Animal skins (not derived from breeding/livestock), Ivory and ivory products, Dangerous substances/materials (according to IATA and ADR regulations), Perishable goods, Seeds, Live animals, Furs, Money, Marketable items and payment cards with value, Plants, Pornographic material, Jewelry and watches (other than bijouterie and bijouterie watches) exceeding USD 500 or equivalent in local currency per shipment¹. Tobacco and tobacco products, Weapons. Likewise, the following are prohibited: Goods under ATA Carnet and all temporary exports and imports; goods under FCR, FCT and CAD (Cash Against Document); shipments with inherent faults which, by their very nature, will tend to contaminate, weaken or damage persons, goods or equipment; goods whose cargo is prohibited by law in the country of origin, transit or destination (e.g. ivory and ivory products); goods which are subject to excise duties (e.g. spirits) or which require special facilities, security measures or permits. Under applicable law, certain goods may only be transported under prescribed conditions, and some goods may not be transported by air (e.g. liquids in glass containers).¹ Bijouterie and bijouterie watches: jewelry and watches for which the retail price is less than USD 150 per item that does not contain precious metal(s) and/or stone(s). Common goods that could potentially be dangerous goods, Airbags (may contain Air Bag inflators, Airbag items or Safety belt buckles.) Construction tools (May indicate the presence of batteries, CO2 cartridges and other power sources, saws or generators running on fuel, radiators that can all contain fuel, flares with kerosene, paint, desiccant and diluent). Cosmetics products (May contain flammable liquids). Cryotechnical fluid (Means a very low temperature liquid gas to be sent as a regulated product). Cylinder/Container/Tank (May contain flammable or non-flammable gas under pressure). Dental care equipment (May contain hazardous chemicals such as resin, solvent, or gases). Swimming pool, Jacuzzi chemicals and spare parts (May contain oxidizing materials or other dangerous goods.) Thermometers (May indicate traces of mercury.) Toolboxes (May contain explosives (rechargeable batteries), pressurized gas (spray cans), flammable glue or paint, corrosive liquids, etc.) Vaccines (May be packed in dry ice.) Poison (Liquid, powder or other may be toxic.) Weather measuring equipment (May indicate the presence of mercury-containing devices.) Battery types (There are many types of batteries available today, and many belong to the regulations on hazardous materials when they need to be transported and must therefore only be sent through a shipping company contracted to ship dangerous goods.) Lead accumulators (Common in cars, electric wheelchairs, certain fixed power sources for computers and other applications. These batteries contain highly corrosive acid and can cause short circuits and thus fire.) Other car batteries (Tested batteries that are not proven to leak must be shipped as non-hazardous material within US borders. Batteries and packages must be labeled "NONSPILLABLE" or "NONSPILLABLE BATTERY") Lithium metal and lithium ion batteries

(These batteries can be both rechargeable and non-rechargeable power sources, and are common in computers, cell phones, cameras and other small electronic devices. If they are dropped, crushed or short-circuited, lithium batteries can develop very high heat temperatures and ignite. They are therefore very dangerous in case of fire.) Other batteries.

Pakke.dk complies with the rules for air transport set up by the International Air Transport Association (IATA) and the rules for road transport established by UN ADR and does not accept dangerous goods in its system - nationally or internationally. Local national regulations also apply to road transport. Companies or individuals sending dangerous goods without proper labeling, documentation and packaging may be subject to substantial financial and legal penalties. It is also important to remember the following when sending items with Pakke.dk: 1 If you recycle packaging or boxes, make sure old labels are removed. Labels marked Farligt Gods/Dangerous Goods on a package will cause the shipment to be withheld and investigated, which will cause delays and inconvenience to you and your customer. 2 If you send goods that might - because of their unusual name, appearance or otherwise - be confused with dangerous goods, but is not, it would be an advantage to state clearly in the shipping documents that they are ‘ikke klassificeret som farligt gods’ (not classified as Dangerous Goods). This ensures that the shipment is not delayed unnecessarily. Any incorrect declarations will result in severe penalties for the sender.
